General Provisions
The contractual terms and conditions set forth below apply to all purchase, exchange, service, work-and-materials, work-only, and similar contracts that we enter into or intend to enter into with the purchasers of our goods and services. Any contractual provisions that deviate from these terms are binding on us only to the extent that we have expressly acknowledged them in writing or to the extent that they comply with mandatory law. The purchaser’s terms and conditions of purchase are generally not binding on us, even if we do not object to them. By placing an order, the purchaser accepts these General Terms and Conditions of Sale and Delivery.
Prices, Offers
Invoice amounts are payable net without any deduction no later than 10 days after the invoice date. Upon expiration of this period, AUTARKING AG is entitled to charge default interest at a rate of 7%. Withholding payments based on any claims by the purchaser, as well as offsetting against any counterclaims, is prohibited. The same provisions apply in the case of partial deliveries.
Availability
Due to the increasingly difficult procurement situation and the resulting challenges for suppliers and manufacturers, we cannot always guarantee the availability of products—and in some cases, services—or deliver them at the specified or desired time. Our suppliers and manufacturers are making every effort to avoid delays and product adjustments as much as possible; unfortunately, this is not always feasible.
We always strive to find a solution that is in the customer’s best interest; however, we hereby exclude any liability in this regard. We also assume no liability for products that are no longer available, even if they are still listed in the online store. We are happy to recommend an alternative.
Retention of Title
The goods remain the property of AUTARKING AG until the date of full payment. The company has the right to have the retention of title entered in the appropriate registry at the customer’s expense.
Delivery Terms
All deliveries are made against prepayment or on account and at the customer’s risk. Any claims for damages or cancellation of the order due to a delay in delivery cannot be accepted. AUTARKING AG is not obligated to insure the goods against damage in transit. We reserve the right to make partial deliveries and to invoice them separately. If delivery is postponed at the purchaser’s request, AUTARKING AG has the right to adjust the prices underlying the order.

Complaints and Warranty
Complaints must be filed immediately upon arrival of the goods; otherwise, the delivery is deemed accepted. Shipments with any transport damage must be accepted with reservation and reported to the relevant carrier within the statutory period for an incident report. Liability for defective materials is limited to AUTARKING AG, at its discretion, either taking back the delivered parts or services or providing a replacement. A claim for rescission or reduction in price exists only if the defect cannot be remedied. The warranty does NOT cover reimbursement of incidental expenses such as installation and removal costs, transportation and consequential costs, etc. Shipping costs are always borne by the customer. All verbal and written information regarding the installation and use of our products is provided to the best of our knowledge, without assuming any specific liability. Damage caused by gross negligence or improper handling is not covered. In all other respects, the warranty provisions of the respective manufacturers apply. In principle, there is no warranty coverage for electronic components.
Returns
As a general rule: Returns or exchanges can only be made if this has been agreed upon with us in advance. For all returns, we require a copy of the delivery slip or invoice.

In addition, every return must be justified! Only undamaged and unassembled new parts in their original packaging can be accepted for return. Opened sets will not be accepted. Parts ordered specifically for you, as well as custom-made items, will not be accepted. We will issue a credit for the full amount, including shipping and handling, for parts that were delivered by us incorrectly or defective, provided they are returned to us within 8 days. For returns received after this period, we reserve the right to deduct a restocking fee. We will issue a credit for parts that you ordered incorrectly or for which there are other reasons for return, minus a 20% restocking fee. You are responsible for the shipping and packaging costs. Electronic components cannot be returned; no returns are accepted. Returns valued at less than CHF 20.— cannot be credited due to cost considerations.
Place of Performance and Jurisdiction
The place of performance and venue shall be UZNACH. The seller expressly waives the right to the ordinary venue.
Final Provisions
Swiss law shall apply exclusively to any disputes; the venue for legal proceedings is UZNACH. Should any individual provisions of these Terms and Conditions be invalid, this shall not affect the validity of the remaining provisions.
